These terms and conditions (the “Terms and Conditions”) govern the use of onfirearmsafety.ca (the “Site”). The site is owned and operated by Wellesley Consulting Services Inc.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on the Site is the property of Wellesley Consulting Services Inc. and the Site’s creators, except where expressly noted. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

Sales of Services

These Terms and Conditions govern the sale of services available through our Site, namely firearm safety courses (CFSC/CRFSC).

The services will be paid in full when the services are ordered, or as otherwise specified in our Registration and Refund Policy.

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we cannot guarantee the accuracy of all such information, descriptions, or images or the services we provide.

Notwithstanding our Registration and Refund Policy, we reserve the right to modify, reject or cancel your order whenever it becomes necessary, in our view. You agree that it is your responsibility to monitor your payment instrument to verify any refund received in accordance with our Refund Policy.

Third Party Goods and Services

Our Site may offer goods and services from third parties, including for similar or identical services as those we offer. We also reserve the right to substitute our service provider with that of a third party offering the same services. We cannot guarantee the accuracy or quality of third party services.

Payments

In accordance with our Registration and Refund Policy, we offer the following payment methods on our Site:

  • Credit card; and
  • Debit

These payment methods are available through our secure payment service provider Stripe, or such other substitute payment service provider that we may from time to time use for this purpose. We do not retain any of your confidential payment information on our Site such as credit card or account numbers, billing address, CSC, expiry date, or financial institution. This information may be retained by our third party payment service provider in accordance with their industry standard policies and processes. We use a Secure Sockets Layer (SSL) encrypted communication protocol to communicate your information to our third party payment service provider, and we only retain a transaction code or alphanumeric identifier to verify that the transaction has been approved or denied.

If we believe your payment has violated any law or these Terms or Conditions, we reserve the right to cancel or reverse your transaction. You agree that you will not use our Site or attempt to make a payment if you are or affiliated to an entity that is sanctioned or banned from making transactions in Canada under the various laws of Canada, such as the Special Economic Measures Act.

Consumer Protection Law

Where the Consumer Protection Act or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. Where there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

We are not responsible for the content, policies, or practices of any third party website or services that is linked to our Site. It is your responsibility to read and understand any terms and conditions and privacy policies of those third party websites and services.

Limitation of liability

Wellesley Consulting Services Inc., and our directors, officers, agents, employees, subsidiaries, and affiliates will not be held liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of this Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Wellesley Consulting Services Inc. and our directors, officers, agents, employees, subsidiaries and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of the use of our Site or a violation of these Terms and Conditions.

Applicable law

These Terms and Conditions are governed by the laws of the Province of Ontario.

Dispute resolution

Subject to any exceptions in these Terms and Conditions, if you and Wellesley Consulting Services Inc. are unable to resolve any dispute through informal discussion, then you and Wellesley Consulting Services Inc. agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Wellesley Consulting Services Inc.. The costs of any mediation or arbitration will be shared by both parties equally.

Notwithstanding any other provision in these Terms and Conditions, you and Wellesley Consulting Services Inc. agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions not affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions maybe amended from time to time in order to maintain compliance with the law and to reflect changes to the way we operate our Site and the way we expect users to behave on our Site.
